Legal Notice

Version 1.0
Effective date: [EFFECTIVE DATE]

This page identifies the operator of the AenVault website and service and gives the operator's legal contact details.

1. Operator

1.1. Who operates AenVault. The AenVault website at aenvault.com (the "Platform") and the AenVault digital time capsule service offered through it (the "Service") are operated and provided by:

  • Operator: Mehmet Karakulak
  • Trading name: AenVault
  • Website: aenvault.com
  • Country of residence or establishment: Türkiye
  • Email: legal@aenvault.com

1.2. Terms used. In the Terms of Service, the Privacy Policy, the Refund Policy and the other AenVault documents, "AenVault", "we" and "us" mean the operator named in Section 1.1. Capitalised terms that are not defined on this page, such as "Capsule", "Capsule Owner", "Content", "Report", "Account Holder" and "Opening Date", have the meanings given in the Terms of Service.

1.3. Personal data. The operator named in Section 1.1 is the controller of the personal data described in the Privacy Policy.

1.4. Payments. Payments on the Platform are processed by a third-party payment service provider that is separate from the operator (the "Payment Provider"). Before you complete a purchase, the checkout step and the Payment Provider's terms tell you which Payment Provider is handling the transaction and which party is responsible for collection, invoicing and taxes.

2. Contacting Us

2.1. Email. You can contact us by email, using the details in Section 1.1.

2.2. What you can contact us about. You can use these details, for example, to:

  • ask a question about the Platform, the Service, your account or a purchase;
  • raise a problem with a payment or a refund;
  • send a statement of withdrawal, where applicable law gives you a right of withdrawal, together with the information listed in the Refund Policy so that we can identify your purchase;
  • tell us that you believe the Service does not conform to the contract;
  • ask about a Report, a Legal Deletion Request or another decision concerning Content; or
  • tell us that you believe a measure concerning your account has been applied in error.

2.3. Requests about personal data. Requests to exercise your rights over your personal data can be sent by email to legal@aenvault.com. This includes requests from people whose personal data appears in an opened Capsule, and requests that cannot be made through the Legal Deletion Request page, for example because you can no longer sign in to an account that has not been deleted. The Privacy Policy explains your rights and how requests are handled.

2.4. Reports and Legal Deletion Requests. To report the Content of an opened Capsule, use the report button on the Capsule's page. The Content Disputes page explains how Reports are made and handled. A Capsule Owner who wants their own sealed Capsule permanently deleted under data protection law can make a Legal Deletion Request through the Legal Deletion Request page.

3. Official Orders, Notarised Notices and Other Legal Notices

3.1. How to send them. The following can be sent by email, using the details in Section 1.1:

  • orders and requests from courts, prosecutors, law enforcement bodies and similar public authorities;
  • notarised notices of rights ownership or copyright infringement;
  • official documents, such as a certificate of inheritance or a guardianship decision, submitted by an heir, guardian or other representative of a Capsule Owner; and
  • other legal notices addressed to the operator.

3.2. What to include. To help us identify the matter and reply, include:

  • the Capsule number of each Capsule concerned or, if it is not known, other information that identifies the Capsule or account concerned;
  • the name of the court, authority or person sending the order, request, notice or document, and contact details for our reply;
  • the date and any reference or case number of the order, request, notice or document; and
  • a copy of the order, request, notice or document.

3.3. How they are assessed. Each order, request, notice or document is assessed by a human administrator, as set out in the Terms of Service. A notarised notice is not an order of a court or public authority and does not by itself require removal. Submitting official documents does not by itself give anyone a right to open a Capsule before the Opening Date of its Collection.

4. Governing Law and Courts

4.1. Law and courts linked to the operator. Under Article 15 of the Terms of Service, the Terms of Service and the contract formed when you purchase a Capsule are governed by the law of the country in which the operator named on this page at the time you complete your purchase (or, if you use the Platform without making a purchase, at the time of use) has its place of residence or establishment, and the courts of that country have jurisdiction over disputes arising from the Terms of Service or from your purchase. The operator's country of residence or establishment is shown in Section 1.1.

4.2. Change of operator. If the operator named on this page changes, the law and courts that applied to your purchase at the time you completed it continue to apply to that purchase and to your Capsule throughout its lifecycle. Purchases completed after the change are governed by the law and courts determined by the operator named on this page at the time of each purchase.

4.3. Your mandatory rights. This does not deprive you of the protection that the mandatory provisions of the law of the country where you habitually reside give you, to the extent that law applies to your purchase, or of any consumer or data protection right that cannot be waived by contract. Nor does it limit any right you have under applicable law to bring proceedings before the courts of your own country, or to contact a competent consumer protection or data protection authority. Article 15 of the Terms of Service sets out these rules in full.

5. Changes to These Details

If the operator's identity or contact details change, the current details are published on this page. If the operation of the Platform and the Service is transferred to another person or entity, the new operator's details are published on this page, and Account Holders are given notice as set out in the Terms of Service.
