AenVault Terms of Service
Version 1.0
Effective date: [EFFECTIVE DATE]
Summary of key points
This summary is provided for convenience only. The full Terms below apply.
- What you buy. A Classic Capsule or a Premium Capsule: a message, and with a Premium Capsule one photograph, that is sealed and kept hidden from everyone, including you, until the fixed Opening Date of its Collection. On that date, all Capsules in the Collection open to everyone at the same time (Articles 2 and 4).
- One-time payment. A Classic Capsule costs USD 2.99 and a Premium Capsule costs USD 4.99. Prices include applicable taxes. There are no subscriptions or recurring charges (Articles 2.3 and 6).
- Fixed Opening Date. Capsules of the first Collection can be created and purchased from 1 November 2026 at 00:00 UTC until 1 February 2027 at 00:00 UTC. They open on 1 November 2030 at 00:00 UTC (Articles 2.4 to 2.6).
- Sealing. Once your payment is confirmed and your Content has passed automated review, your Capsule is sealed, receives a Capsule number and can no longer be edited (Articles 4.1 and 4.4).
- Locked from everyone. From sealing until the Opening Date, no one, including you, can access the Content (Articles 4.2 and 4.3).
- Public and lasting. From the Opening Date, Content is public. After three months it moves to the Archive, which has no fixed end date (Articles 2.7, 2.8 and 10).
- Message Rules. Personal information (including your own), a first name together with a surname, links and photographs of anyone under 18 are not allowed (Article 8).
- Reports. Anyone can report an opened Capsule. Reported Capsules are hidden while the report is handled. AenVault does not decide disputes about rights; courts do (Article 9).
- Deleting. You can delete your own Capsule at any time, after a 14-day waiting period. Deletion is permanent and does not give rise to a refund (Article 11).
- Refunds. AenVault does not grant refunds on request, for example because of a change of mind. Your statutory rights are not affected, and refunds are given in the cases set out in Article 7.
- Early closure commitment. If AenVault decides to close, sales stop on the day of that decision, every Collection opens to everyone for 90 days, and you are emailed so that you can download your message (Article 13.2).
- Age. You must be at least 18 years old (Article 3.3).
- Who sells to you. Lemon Squeezy sells the Service to you as merchant of record and takes your payment. AenVault provides the Service (Article 1.4).
- Who we are. The operator's identity and contact details are on the Legal Notice page (Article 1.2).
Article 1 — Parties and Scope
1.1. Subject matter. These Terms of Service ("Terms") govern your use of the AenVault website at aenvault.com (the "Platform") and the digital time capsule service offered through it (the "Service"). The Platform and the Service are offered to users in many countries around the world.
1.2. Operator and Legal Notice page. The identity, trading name, email address and other legal contact details of the person or entity that operates the Platform and provides the Service ("AenVault", "we", "us") are published on the Platform's "Legal Notice" page. The purpose of that page is to provide operator identity and legal contact information. It can be viewed without signing in and is accessible to you before you complete a purchase. In these Terms, "AenVault" means the operator named on that page. If the operator's identity or contact details change, the current details will be published on the same page. A change of operator is dealt with in Article 13.6.
1.3. Definitions. In these Terms:
- "User" means anyone who visits or uses the Platform;
- "Account Holder" means a User who has created an account on the Platform;
- "Primary email address" means the email address with which an account is opened and through which it is accessed;
- "Capsule" means the unit of content that an Account Holder creates through the Service, consisting of a message and, for a Premium Capsule, one photograph;
- "Package" means a Classic Capsule or a Premium Capsule, as described in Article 2.3;
- "Capsule Owner" means the Account Holder who created a Capsule and in whose account the Capsule is recorded;
- "Content" means the message text and the photograph placed in a Capsule;
- "Period", "Collection", "Writing Window", "Lock Period", "Opening Date", "Display Period" and "Archive" have the meanings given in Article 2.4;
- "Sealing" and "sealed" have the meaning given in Article 4.1;
- "Payment Provider" and "Lemon Squeezy" mean Lemon Squeezy, the third party, separate from AenVault, that acts as the merchant of record for purchases under these Terms and carries out the payment part of a purchase, as described in Article 1.4;
- "Message Rules" means the rules on Content set out in Article 8.2;
- "Report" means a report about the Content of a Capsule made under Article 9; and
- "Legal Deletion Request" has the meaning given in Article 12.1.
1.4. Lemon Squeezy and purchases. Purchases of Capsules under these Terms are handled by Lemon Squeezy, which acts as the merchant of record and an authorised reseller for the Service. When you complete a purchase, you buy the Service from Lemon Squeezy under Lemon Squeezy's Buyer Terms, which you accept by completing the purchase, and AenVault provides the Service to you under these Terms. Payments for Capsules are taken outside AenVault's own systems, through Lemon Squeezy. Lemon Squeezy collects the payment, charges any applicable taxes and sends your order confirmation, receipts and invoices. Before you complete a purchase, the checkout step and Lemon Squeezy's Buyer Terms tell you the payment terms and any consumer information that applies to the transaction. The payment transaction itself is also subject to Lemon Squeezy's Buyer Terms.
1.5. Scope and applicable version. These Terms apply to all use of the Platform, including viewing its public pages, to the creation of accounts and to the purchase of Classic Capsules and Premium Capsules. If AenVault offers other products, any additional terms that apply to them are presented before purchase and apply together with these Terms. When you purchase a Capsule, you give, at checkout, the confirmations set out in Article 5.6.
Your purchase is governed by the version of these Terms that is in effect at the time you complete it. AenVault records, for each purchase, the version of these Terms that applied. Earlier versions remain available on the Platform so that those who purchased under them can consult them.
1.6. Related documents. These Terms should be read together with the following documents:
- Privacy Policy: explains how personal data is collected, processed, stored and transferred, and sets out data subject rights.
- Refund Policy: contains the specific provisions on refunds, refund exceptions and payment disputes (chargebacks).
- Message Rules page: presents the Message Rules set out in Article 8.2.
- Content Disputes page: explains how to make a Report and how Reports and responses are handled.
- Legal Deletion Request page: provides the form described in Article 12.4.
- Cookie information: explains cookies and how to manage your cookie preferences.
- Legal Notice page: described in Article 1.2.
These documents complement one another. Details on refunds and payment disputes are set out in the Refund Policy. The rules on Capsule Content and their effect on Capsules are set out in these Terms.
1.7. Mandatory rights. Nothing in these Terms removes or limits any consumer or data protection rights granted to you under applicable mandatory law that cannot be waived or limited by contract. No provision of these Terms may be interpreted in a way that conflicts with those rights. Where such a right applies, the relevant provision of these Terms applies only to the extent the applicable mandatory law permits.
Article 2 — Nature of the Service
2.1. What the Service is. AenVault is a digital time capsule service that you purchase with a one-time payment. You create a Capsule containing your Content. Once payment has been confirmed and the Content has passed automated review, as described in Article 4.1, the Capsule is sealed. From that point until the fixed Opening Date of the Collection to which the Capsule is assigned, the Content is kept inaccessible to everyone, including you. On the Opening Date, the Content of all Capsules in the Collection is made public at the same time. It stays public in the Display Period and is then moved to the Archive. AenVault stores and processes the Content securely as part of this lifecycle.
2.2. What you purchase, and what you do not. What you purchase is the AenVault digital time capsule service: the creation, sealing and later opening of your Capsule according to the Collection lifecycle. The Lock Period is the stage of the Collection lifecycle in which the Content of sealed Capsules is inaccessible. The Lock Period and this access restriction are not a separately purchased service, storage period or product.
AenVault is not a subscription or recurring service, a cloud storage or file hosting service, a personal storage space with ongoing access, a backup service, or a messaging platform. You do not rent storage capacity from AenVault. This Article describes how the Service works. It does not affect your rights under applicable mandatory law (Article 1.7).
2.3. Packages and one-time payment. The following Packages are sold under these Terms:
| Package | Price | Content |
|---|---|---|
| Classic Capsule | USD 2.99 | A message of up to 2,500 characters |
| Premium Capsule | USD 4.99 | A message of up to 2,500 characters and 1 photograph |
Every Package is a one-time payment. There are no subscriptions, automatic renewals or recurring charges. Prices are stated in US dollars (USD) and include applicable taxes. The scope and price of each Package are shown on the Platform before you purchase.
2.4. Periods and Collections. The Service follows a yearly cycle. A new Period begins on 1 November of each year at 00:00 UTC. All Capsules created for a Period form one Collection, and every Capsule in a Collection shares the same dates:
- Writing Window: the time during which Capsules for the Collection can be created and purchased. It runs from 1 November at 00:00 UTC, when the Period begins, until 1 February of the following year at 00:00 UTC.
- Lock Period: the Collection-wide period, from the start of the Period until the Opening Date, during which the Content of sealed Capsules is not shown to anyone.
- Opening Date: 1 November at 00:00 UTC, four years after the start of the Collection's Period. On the Opening Date, the Content of all Capsules in the Collection is made public together and at the same time.
- Display Period: the three months that begin on the Opening Date.
- Archive: the final stage of the same lifecycle, which begins when the Display Period ends and in which Content is available on the Archive pages.
In these Terms, each stage includes its start time and ends immediately before its end time. Capsules can be created and purchased only during a Writing Window. Between the end of a Writing Window (1 February) and the start of the next Period (1 November), no Capsules can be created or purchased. From 2030 onwards, a Collection opens on 1 November of each year, on the same day a new Period begins. The Display Period of one Collection can therefore run at the same time as the Writing Window of a later Collection.
2.5. The first Collection. The calendar of the first Collection is as follows (all times are 00:00 UTC):
| Stage | Start | End |
|---|---|---|
| Writing Window | 1 November 2026 | 1 February 2027 |
| Lock Period | 1 November 2026 | 1 November 2030 |
| Display Period | 1 November 2030 | 1 February 2031 |
| Archive | 1 February 2031 | No fixed end date (Article 2.8) |
The first Collection opens, and its Content is made public, on 1 November 2030 at 00:00 UTC.
All Collection dates and times are set and applied in Coordinated Universal Time (UTC). Your local time may differ from UTC, and in some time zones the opening falls on a different calendar date. For example, 00:00 UTC on 1 November 2030 is 8:00 p.m. on 31 October 2030 in New York, midnight on 1 November 2030 in London and 9:00 a.m. on 1 November 2030 in Tokyo. Standard time-zone tools can convert UTC to your local time. Collection dates are fixed by reference to UTC and are not adjusted for individual time zones.
2.6. Fixed Opening Date. The Lock Period is a fixed, Collection-wide period. It does not start on the date you purchase, it is not an individual timer, and it is not a period of storage that you buy. The Opening Date of the Collection to which your Capsule is assigned is fixed when you purchase and will not be changed by AenVault unilaterally. The only exception is the early closure commitment in Article 13.2, under which all Collections are opened to everyone before their Opening Dates. This is subject to applicable mandatory law (Article 1.7).
As a result, the time between the date your Capsule is sealed and the date it opens depends on when that happens, and it can be different for people who purchase early and people who purchase later. For example, a Capsule of the first Collection sealed on 1 November 2026 opens four years later, on 1 November 2030. A Capsule of the same Collection sealed at the end of January 2027 opens on the same date, about three years and nine months later. If your payment is confirmed or your Capsule is sealed after the Writing Window has ended (Article 5.8), the Capsule stays in its Collection, and the Collection's dates do not change.
Before you complete a purchase, AenVault shows you, at the Complete Purchase step and at checkout, the fixed Opening Date and time (in UTC) of the Collection to which your Capsule will be assigned and the approximate time that will remain until that date. You should review this information before you purchase. The Collection and its Opening Date are also stated in your purchase confirmation.
2.7. Display Period. On the Opening Date, the Content of all Capsules in the relevant Collection is made public and can be viewed by anyone. Article 4 sets out that no one, including the Capsule Owner, can access Content before that opening. The licence for the public display of Content is addressed in Article 10, and responsibility for Content in Article 8. At purchase, you expressly confirm that your Content will be made public and will remain available in the Archive as described in Article 2.8.
2.8. Archive. When the Display Period ends, Content is moved to the Archive pages. The Archive is the final stage of the Collection lifecycle. It is not a separate storage service, subscription or additional product. Archived Content is kept and remains available on the Archive pages, and AenVault does not set a fixed end date for the Archive stage. The retention and availability of archived Content are limited only by:
- applicable data protection obligations;
- the grounds for removal set out in Article 4.5, including Reports, the deletion of a Capsule by its Capsule Owner, Legal Deletion Requests, payment disputes (chargebacks) and lawful orders of courts, prosecutors and other competent public authorities; and
- other mandatory legal requirements.
AenVault will maintain the Archive using reasonable efforts. It does not guarantee that archived Content will remain available under all circumstances or without interruption. Access to archived Content is provided through server-side access mechanisms rather than fixed public file links. Provisions on the continuation, closure or transfer of the Service are set out in Article 13. Nothing in this Article limits AenVault's responsibilities under mandatory consumer law (Article 1.7).
Article 3 — Accounts and Age Requirements
3.1. Accounts. You can view the Platform's public pages, including the Packages, opened Capsules, the Archive and legal documents, without an account. You can also make a Report without an account (Article 9.1). An account is required to create a Capsule, write and save a message, upload a photograph and make a purchase. An account is opened with an email address, which must be verified before you can create a Capsule.
3.2. Account information. You are responsible for keeping your account information accurate and up to date, including your primary email address, and for keeping your account credentials confidential. You can create more than one Capsule with one account. There is no commercial limit on the number of Capsules. However, request rate limits apply to prevent abuse.
3.3. Age requirement and declarations. To open an account and purchase the Service, you must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction. When you create an account, you are required to declare that you meet both requirements. When you purchase a Capsule, you separately confirm at the checkout step that you are at least 18 years old. You must provide accurate information in these declarations and in your account, and you are responsible for their accuracy. People under 18 cannot open an account or purchase a Capsule, even with the consent of a parent or guardian.
3.4. Message recipient versus Account Holder. A message may be addressed to a child, a minor or a person in the future. For example, a parent may leave a message for their child. Choosing who a message is addressed to is a choice about the content. The recipient does not become a user of the Service or a party to these Terms, and the recipient's age does not affect the 18-year age requirement. The person who creates the Capsule, makes the payment and is responsible for the Content is always an Account Holder who is at least 18 years old. Because Content will be made public, the Message Rules do not allow personal information, a first name together with a surname, or a photograph of anyone under 18 (Article 8.2). The Account Holder is responsible for any information about third parties, including minors, that Content contains. This does not affect AenVault's own obligations under applicable data protection law as a controller of the personal data it processes.
3.5. Access to your account. Your account, and every Capsule recorded in it, is accessed through your primary email address and your credentials, using the sign-in and password reset procedures that the Platform makes available. If you lose access to your primary email address, you may be unable to use your dashboard, including for Capsules that have already been sealed. In that case, you can contact support and verify that a Capsule is yours by providing the email address of the account and proof of payment that matches our records (the payment date, the amount and the Lemon Squeezy order or transaction reference). The Capsule number helps but is not required. A successful verification gives you rights only in respect of the Capsule concerned. It does not restore access to the account, and it does not change the email address of the account. This does not open or release any sealed Content (Article 4.3).
Access to an account and data protection rights are different matters. Losing access to your account does not remove any right you have under applicable data protection law, and you may exercise those rights by contacting us using the details on the Legal Notice page.
3.6. Optional secondary notification email. You may add an optional secondary notification email address to a Capsule; you can change it later, including after the Capsule is sealed. This address has no account management authority, and it receives no notice when you register or make a purchase. It cannot be used to sign in or to reset a password, and it gives no authority to manage Capsules, make purchases or make a Legal Deletion Request. Its only function is to receive the same notification, with the same content, that is sent to your primary email address when the Collection opens. Delivery of that notification depends on email delivery and on the accuracy of the addresses you have given us, and it is not a condition of the opening or public display of the Collection (Article 13.4).
3.7. Account deletion. You can delete your account as set out in Article 11.2.
Article 4 — Sealing, Content Lock and Access Restrictions
4.1. Sealing. A Capsule is "sealed" when payment has been confirmed and the current version of the Content has passed automated review. Sealing is not necessarily the same moment as payment.
Content is screened by automated review when it is saved (Article 5.3). Content that does not pass the review is not saved. Two conditions must both be met for a Capsule to be sealed: (i) Lemon Squeezy has successfully confirmed the payment, and (ii) the current version of the Content has passed automated review. Lemon Squeezy may confirm a payment before the review result is final. In that case, the Capsule is in a "payment received, review pending" stage. At this stage the Capsule is not yet sealed. You can see the Capsule's current status in your account dashboard, but seeing a status is not access to the Content, and nothing in this stage gives you a right to edit or replace the Content. If the review finds the Content acceptable, the Capsule is sealed. If it does not, the Capsule is not sealed and is removed, and the payment is refunded as set out in Article 7.2.
When a Capsule is sealed, it is assigned a Capsule number. A Capsule number is never reassigned to another Capsule, even if the Capsule is later removed or deleted. A purchase confirmation is then sent to the Account Holder's primary email address. It states the Capsule number, the Package, the Collection to which the Capsule is assigned and the Collection's fixed Opening Date, and it summarises the early closure commitment in Article 13.2. The confirmation is informational only and is not a certificate or a legal document of any kind.
4.2. Access restriction for sealed Capsules. From the moment a Capsule is sealed until the Opening Date of its Collection, no one, including the Capsule Owner, can access the Capsule's Content (message text and photograph). During this period, AenVault does not provide anyone, including the Account Holder, with access to the Content. In your account dashboard, you can see non-content information about the Capsule, such as its existence, its number, its Package, the Collection it is assigned to and its status. The access restriction is a feature of the Service. It does not remove or limit any right you have under applicable data protection law, including, where that law gives them to you, rights of access, correction and erasure, or any decision of a competent authority (Article 1.7). Requests concerning your personal data are handled under the Privacy Policy and applicable law.
This restriction does not prevent our systems from technically processing Content in order to operate the Service (for example, encrypting it, storing it and running automated review). It means that the Content is not shown or made available to Users or the public.
4.3. No early access. There is no request, payment or other way to open a Capsule before the Opening Date of its Collection. AenVault will not open a Capsule early at your request. The death or loss of legal capacity of an Account Holder also does not give heirs, guardians or third parties a right to early access (Article 16). The only case in which Collections open before their Opening Dates is the early closure commitment in Article 13.2. This does not prevent the application of mandatory rights recognised by applicable law that cannot be waived by contract, or of decisions of public authorities.
4.4. Content cannot be changed. Content cannot be changed at any of the following stages:
- while a payment attempt for the Capsule is active, that is, while checkout for the Capsule has been opened and the payment has not yet been completed or ended, in which case the Capsule cannot be edited until the payment process has concluded;
- once payment has been completed and the Capsule is in the "payment received, review pending" stage; and
- once the Capsule has been sealed.
Nothing in this Article gives you a right to edit, replace or recover Content at any of these stages. A sealed Capsule cannot be edited. It can be deleted or removed only in the cases set out in Article 4.5. This Article does not remove any rights you have under applicable law that cannot be waived by contract (for example, withdrawal rights, rights relating to the conformity of digital content or digital services and remedies for non-conformity, and rights relating to personal data).
4.5. When a sealed Capsule can be removed. A sealed Capsule, including one in the Display Period or in the Archive, can be deleted or removed only in the following cases:
- its Capsule Owner deletes it, or chooses to delete their Capsules when deleting their account (Article 11);
- a Report leads to its permanent removal (Article 9);
- a Legal Deletion Request from its Capsule Owner is approved after ownership verification and review (Article 12);
- a lawful order from a competent court, prosecutor, law enforcement body or similar public authority, or another mandatory legal requirement, applies (Article 17);
- a notarised notice of rights ownership or copyright infringement is received and, after review by a human administrator, the administrator decides that removal is justified (Article 17); or
- a payment dispute (chargeback) concerning the payment for the Capsule is finally resolved in the customer's favour (Article 7.6).
In addition, under Article 9.4 only the photograph of a Capsule may be removed while its message text remains. Hiding, removing or deleting a Capsule affects only that Capsule. It does not affect your other Capsules or your account.
4.6. Security of the access restriction. AenVault applies reasonable technical and organisational security measures to keep sealed Content from being shown. Message text is encrypted on the server side before it is stored, and access to photographs is provided through controlled access mechanisms rather than permanent public links. No security system can provide absolute protection. These Terms do not guarantee that unauthorised access can never occur under any circumstances, or that the system will operate without interruption or error. Nothing in this Article limits any liability of AenVault that cannot be limited or excluded under applicable mandatory law, including in relation to data security obligations.
Article 5 — Creating and Purchasing a Capsule
5.1. Two separate steps. Creating and buying a Capsule takes two separate steps, "Save Message" and "Complete Purchase".
- Save Message saves your message and photograph after automated review. It is not a purchase. It does not start a payment, does not seal the Capsule and does not assign a Capsule number.
- Complete Purchase starts the payment for Content that has already been saved. It does not save or change your Content.
5.2. Limit on message checks. Each use of Save Message counts towards a limit on the number of message checks available to your account across all your Capsules. Submitting exactly the same Content again, and attempts that fail because of a system error or timeout, do not count. When the limit is reached, Save Message cannot be used until you complete a purchase of your own, which restores the limit. If you reach the limit without ever having had a message saved successfully, the limit is restored 30 days after you first used Save Message. The number of remaining checks is not shown; a message tells you when the limit has been reached.
5.3. Automated review when saving. Your message is saved only if automated review finds the Content acceptable. Before the review, an automated check looks for phone numbers, email addresses, identification numbers and links, and a message containing them is not saved (Article 8.2). If the review does not find the Content acceptable, or cannot be completed because of a technical error or timeout, the message is not saved and you are told so that you can revise the Content or try again. If you had already saved an earlier version, that version stays as it was.
5.4. Photographs. With a Premium Capsule, you may upload one photograph before you pay. When you upload it, you confirm that it does not show anyone under 18 (Article 8.2). Photographs are stored privately and are not shown to anyone. If you change your photograph after saving, you must use Save Message again, and the Content must pass automated review, before you can purchase. Changes are not possible while a payment attempt is active (Article 4.4).
5.5. Conditions for Complete Purchase. Complete Purchase is available only when all of the following are met:
- the current version of your Content has been saved and has passed automated review;
- you have ticked all of the confirmations shown with the button (Article 5.6); and
- the Writing Window of the Collection is open and the Service is open for purchases.
Our systems enforce these conditions. They do not depend only on the buttons shown on the page.
5.6. Information and confirmations at checkout. At the Complete Purchase step and at checkout, you are shown the fixed Opening Date of the Collection and the approximate time remaining until it (Article 2.6), a summary of the early closure commitment (Article 13.2) and the information that Lemon Squeezy sells the Service to you as merchant of record (Article 1.4). With Complete Purchase, you are asked to confirm, in three separate confirmations, that:
- you are at least 18 years old, you accept these Terms and the Refund Policy, and you have taken note of the Privacy Policy;
- no one, including you, can read your Capsule until the Opening Date, and it then becomes public and stays publicly available in the Archive with no fixed end date, as described in Article 2; and
- your Content follows the Message Rules (Article 8.2), and you are responsible for any Content that does not follow them, including any photograph you uploaded.
AenVault records the time at which you gave these confirmations and the version of the text you confirmed. If applicable law requires other information, consents or acknowledgements in connection with your purchase, the checkout also presents them (Article 7.3).
5.7. Saved but unpaid Content. If you save a Capsule but do not pay for it, we keep the saved Content for 14 days. The 14 days start at your first successful Save Message. Editing and saving again do not restart them. If payment has not been completed when the 14 days end, the Content and any photograph are permanently deleted. If the Writing Window ends before the 14 days have passed, Article 5.8 applies instead.
5.8. End of the Writing Window. When the Writing Window of a Collection ends, all Capsules assigned to that Collection whose payment has not been completed are permanently deleted, even if 14 days have not passed. For the first Collection, this happens on 1 February 2027 at 00:00 UTC. A Capsule whose payment has been completed and whose automated review is still pending is not affected. It stays assigned to its Collection. After a Writing Window has ended, no new Capsules can be created or purchased for that Collection.
5.9. Payments in progress. We do not delete a Capsule under Article 5.7 or 5.8 while a payment attempt for it is open, or while its payment status is being confirmed with Lemon Squeezy. If the payment is confirmed, Article 4.1 applies.
5.10. Effect of deletion. AenVault cannot restore Content that has been deleted under this Article. Information about backup copies is in the Privacy Policy. Article 11.2 governs what happens to unpaid Capsules when an account is deleted. Nothing in this Article limits your data protection rights under applicable law (Article 1.7).
Article 6 — Payments, Prices and Taxes
6.1. Lemon Squeezy. Each purchase is processed by Lemon Squeezy. You enter your payment details in Lemon Squeezy's checkout, which is displayed within your dashboard on the Platform. AenVault does not collect your card details. Lemon Squeezy processes your payment details under its own terms and privacy notices.
6.2. Seller, invoicing and tax details. As stated in Article 1.4, Lemon Squeezy is the merchant of record for your purchase. Lemon Squeezy collects the payment, charges applicable sales taxes such as VAT and is responsible for them, and sends your order confirmation, receipts and invoices electronically. Lemon Squeezy's role in your purchase does not change the nature of the Service or the way Capsules and Content are handled under these Terms and the Privacy Policy.
6.3. Prices, taxes and fees. Prices are shown in US dollars (USD) and include applicable taxes. The price you pay is the price of the selected Package shown to you at checkout, and the total amount you will be charged is shown to you before you complete the payment. Your bank or card issuer may apply currency conversion charges or other fees under your agreement with it. These are outside AenVault's control. Prices may change for future purchases. A change does not affect a purchase you have already completed. Every payment is a one-time payment (Article 2.3).
6.4. Discount codes. AenVault does not run discounts, campaigns or launch prices. The only discount is the single-use code described in Article 9.5, which you enter yourself at checkout.
6.5. Payment confirmation and sealing. A Capsule is not sealed unless Lemon Squeezy has successfully confirmed the payment. Payment and sealing are not always the same moment. Sealing also depends on the result of automated review, as described in Article 4.1. Confirmation of a payment may be delayed. If it is, we check the payment's status with Lemon Squeezy and do not treat the payment as failed solely because of the delay.
6.6. Declined or unconfirmed payments. A payment that is declined, cancelled or not confirmed does not result in a sealed Capsule.
6.7. Related provisions. Refunds, statutory rights and payment disputes are addressed in Article 7.
Article 7 — Refunds, Statutory Rights and Payment Disputes
7.1. Relationship with the Refund Policy. This Article gives an overview. The specific provisions on refunds, refund exceptions and payment disputes are in the Refund Policy, which should be read together with these Terms.
7.2. AenVault's refund policy. Once payment has been completed, the Capsule enters the sealing process (Article 4.1), and sealed Content cannot be edited (Article 4.4). For this reason, and subject to Article 7.3, AenVault does not offer a right to cancel as its own commercial policy and does not grant refunds that the Account Holder requests on their own initiative, for example because of a change of mind.
A refund is made in the following cases:
- Automated review. If the Content of a Capsule is not found acceptable by automated review after payment has been taken, the Capsule is not sealed, it is removed and the payment is refunded.
- Error by AenVault. If a Capsule is removed in the Report process because of an error made by AenVault, the payment is refunded.
- Payment dispute. If a payment dispute is finally resolved in your favour, the payment is returned to you through the dispute process handled by Lemon Squeezy and your bank or card issuer. AenVault does not issue a separate refund for the same payment.
- Lemon Squeezy refund. As the seller, Lemon Squeezy may refund a payment at its own discretion under its Buyer Terms, or under a statutory right that applies to your purchase. Such a refund is Lemon Squeezy's own process, and AenVault does not issue a separate refund for the same payment.
Unless applicable law requires otherwise, no refund is made in the following cases:
- a Capsule is removed following a Report, except where the removal resulted from an error made by AenVault (Article 9.9);
- you delete a Capsule yourself, or choose to delete your Capsules when you delete your account (Article 11);
- a Capsule is removed following a Legal Deletion Request (Article 12); or
- a Capsule is removed under an official order or mandatory requirement (Article 17).
If only the photograph of a Capsule is removed under Article 9.4, no partial refund is made, and you receive the discount code described in Article 9.5.
7.3. Your statutory rights. Some consumers have rights under applicable law that apply regardless of AenVault's refund policy. Examples are a right to withdraw from a distance contract within a set period and remedies for digital content or digital services that do not conform to the contract. Whether such a right applies to you depends on the law that applies to your purchase, on whether you are acting as a consumer, and on the nature of the purchase. The refund provisions in these Terms and in the Refund Policy are AenVault's commercial policy. They apply in addition to your statutory rights and do not replace them. Nothing in these Terms, in the Refund Policy or in the confirmations at checkout excludes or limits a right that applies to you and cannot be waived by contract.
Whether you have a right of withdrawal, and whether and under what conditions it can be lost or ended, is determined by the law applicable to your purchase. Where that law provides that the right is lost or ended once certain conditions are met, such as your prior express consent that performance begins and your acknowledgement of the consequence, AenVault treats the right as lost or ended only if, and to the extent that, those conditions are met under that law in your case. The information, consent requests and acknowledgements shown at checkout are presented for that purpose. They do not by themselves decide whether a right of withdrawal applies to you or has ended, and they do not remove a right that applicable law does not allow to be lost in that way. Information on how to exercise any such right, including any means of making a withdrawal statement that applicable law requires to be made available, is provided in the Refund Policy and at checkout.
7.4. How refunds are made. Refunds are made through Lemon Squeezy to the original payment method. The refund is the amount you were charged, in the currency in which you were charged, and AenVault does not deduct any currency conversion loss or transfer cost from it. Charges that your bank or card issuer applies under your agreement with it are outside our control. The time until the money appears in your account depends on Lemon Squeezy and on your bank or card issuer.
7.5. Separate processes. A Report concerns the Content of a Capsule and is handled under Article 9. A payment dispute (chargeback) is a dispute of a payment raised with Lemon Squeezy, your bank or your card issuer. A Legal Deletion Request is a request for permanent deletion of a Capsule under Article 12. The deletion of your own Capsule or account is your own decision under Article 11. These are four different processes. The outcome of one does not decide the outcome of another.
7.6. Payment disputes. Nothing in these Terms limits your right to dispute a payment with your bank, card issuer or Lemon Squeezy under your agreement with them or under applicable law. If you have a problem with a payment, we encourage you to contact us using the details on the Legal Notice page. Because Lemon Squeezy is the seller for your purchase, you can also contact Lemon Squeezy; its Buyer Terms ask buyers to contact it before raising a payment dispute with their bank or card issuer. While a payment dispute is pending, the Capsule stays visible according to its stage in the Collection lifecycle, and we do not process a separate refund for that same payment. If the dispute is finally resolved in your favour, the Capsule is permanently removed (Article 4.5) and the payment is returned to you through the dispute process handled by Lemon Squeezy and your bank or card issuer. No refund is made twice for the same payment.
Article 8 — Message Rules and Responsibility for Content
8.1. Your responsibility for Content. You are responsible for your Content, including any photograph you upload. You must ensure that it follows the Message Rules and does not infringe the copyright, trademark, personality, privacy or other rights of any third party. The fact that Content is not public until the Opening Date does not remove this responsibility.
8.2. Message Rules. Your Content must comply with applicable law and with the following Message Rules. Content must not contain:
- Personal information of anyone, including your own, such as phone numbers, addresses, email addresses or identification numbers. A statement that the information is your own does not make it allowed, and AenVault does not investigate whose information it is.
- A first name together with a surname. A first name on its own, a nickname or a family word (such as "Mum" or "Grandad") is allowed. The name of a well-known person or of a fictional character is not, by itself, personal information.
- Links to websites or other online addresses.
- A photograph of anyone under 18. What matters is the person's age when the photograph is uploaded. A childhood photograph of yourself is also not allowed.
- Content that infringes the copyright, trademark, personality, privacy or other rights of any third party.
- Threats of violence, or content that incites or glorifies violence against any person or group.
- Hate speech, or content that incites hatred or discrimination against a person or group because of characteristics such as race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, disability or age.
- Content that harasses, bullies or intimidates any person.
- Sexually explicit content, any sexual content involving minors, or content that endangers the safety of children.
- Content that encourages or promotes suicide or self-harm, or gives instructions for it.
- Spam, fraud or other unlawful content.
The Message Rules apply to message text and photographs alike. They describe what AenVault does not accept in the Service. They do not limit anything that applicable law requires AenVault to remove. The Message Rules are also presented on the Message Rules page, and a reminder of them is shown in the message editor before you save.
8.3. How the Message Rules are applied.
- Same rules for everyone. The Message Rules apply to everyone in the same way. Whether a breach was intended is not taken into account.
- When saving. The automated check and review described in Article 5.3 apply when you use Save Message. Content that is not found acceptable is not saved. Names are not checked automatically: the rule on a first name together with a surname is applied when a Report is made or during a review by an administrator.
- Photographs. Our systems cannot determine a person's age. Responsibility for following the rule on photographs rests with the person who uploads the photograph, who confirms this when uploading and again at checkout.
- After payment. If automated review after payment does not find the Content acceptable, the Capsule is removed before it is sealed, AenVault informs you at your primary email address, and the payment is refunded (Article 7.2). You may create a new Capsule with revised Content during a Writing Window.
- After sealing. Concerns about the Content of a sealed Capsule are handled through the Report process in Article 9. A sealed Capsule can be removed only in the cases set out in Article 4.5.
- Effect. A breach of the Message Rules affects only the Capsule concerned. It does not lead to any restriction of your account.
- Approach. AenVault applies the Message Rules in an objective and proportionate manner, with due regard to the rights and legitimate interests of everyone involved, including freedom of expression.
- Questions and mandatory rights. If you believe a decision about your Content is wrong, you can contact us using the details on the Legal Notice page. Where applicable law requires AenVault to give you a statement of reasons or other information about a decision concerning your Content, AenVault provides it. This does not limit any right you have under applicable law, including rights relating to automated decision-making under data protection law (Article 1.7).
8.4. Review is not verification. AenVault's review of Content, whether by automated review or by an administrator, is a check made under the Message Rules. It is not a certification or verification that Content is lawful or free of third-party rights, and it does not reduce your responsibility under Article 8.1.
Article 9 — Reports, Hiding and Removal
9.1. Making a Report. After a Collection has opened, anyone can report the Content of a Capsule using the report button on the Capsule's page. No account is needed. A Report is made under one of the following topics: rights violation (copyright, trademark or other rights); personal information or photo; harassment, hate or violence; sexual content or child safety; self-harm; spam, fraud or illegal content; or other. Reports about a rights violation and reports under "other" require verification of the reporter's email address. Each Report receives a reference number. How to make a Report, and what information each topic requires, is explained on the Content Disputes page.
9.2. Temporary hiding. When a Report is made under any topic other than "other", the Capsule concerned is hidden. It is not deleted automatically. A Report under "other" does not hide the Capsule; an administrator reviews it first. An administrator may also hide a Capsule on AenVault's own initiative. While a Capsule is hidden, it is not displayed in the Display Period or the Archive, and it cannot be reported again. Hiding a Capsule does not change the fixed dates of its Collection. It does not pause or extend the Display Period for that Capsule, and it does not by itself give rise to a refund or any other adjustment. If the Capsule is shown again, it continues through the Collection lifecycle according to the Collection's fixed dates, from the stage the Collection has reached at that time.
9.3. Rights violations: AenVault does not decide. AenVault does not act as a judge between a person who claims that Content infringes their rights and the Capsule Owner. Whether a right has been infringed is for the courts to decide. AenVault follows the time limits, the form of the documents and the records of the process. For a Report about a rights violation:
- The Capsule Owner is notified at their primary email address and is shown the name of the reporter (or the reporter's company) and the basis of the claim. The reporter's email address, postal address and documents are not shown.
- The Capsule Owner can submit a response within 15 days of the notification, through a response page in their dashboard. When the 15 days end, the page closes, and text that has been written but not submitted is not sent.
- If no response is submitted, the Capsule stays hidden and is permanently removed one year later.
- If a response is submitted, the reporter is asked to provide proof, within 15 days, that they have started court proceedings (the court, case number and date). If the proof is provided, the Capsule stays hidden while the court proceedings continue, and it is then shown again or removed according to the court's decision, which the successful party sends to AenVault. Until a decision is sent, the Capsule stays hidden. If no proof is provided within the 15 days, the Capsule is shown again. If proof is provided later, the Capsule is hidden once more.
- A Capsule is permanently removed under this Article 9.3 only if no response is submitted within the response period and one year has passed, if a court decides that the Content infringes the right, or if the Capsule Owner accepts the claim.
9.4. Personal information or photo. For a Report about personal information or a photo, the reporter states whether the problem is in the text or in the photograph, and an administrator reviews the hidden Content.
- If the problem is in the text and the Content breaches the Message Rules, the Capsule is permanently removed. If it does not, the Capsule is shown again.
- If the problem is in the photograph and the person shown is clearly an adult, the Capsule is shown again. If the person's age cannot be determined, or the person appears to be young, only the photograph is permanently removed, and the message text is shown again.
9.5. Discount code after removal of a photograph. If only the photograph of your Capsule is removed under Article 9.4, AenVault informs you at your primary email address and gives you a one-time code for 50% off the purchase of a Classic Capsule or a Premium Capsule. The code is linked to your email address, can be used only once, is not transferable and has no cash value. It has no expiry date, but it can be used only when a Writing Window is open, because Capsules can be purchased only then.
9.6. Other topics. For a Report about harassment, hate or violence; sexual content or child safety; self-harm; spam, fraud or illegal content; or "other", an administrator reviews the Content. If the Content breaches the Message Rules, the Capsule is permanently removed. If it does not, the Capsule is shown again. There is no separate response or appeal procedure for these topics. If a Report under "other" concerns a claim of rights, the reporter is directed to the procedure for rights violations.
9.7. Decisions are made by people. Automated systems, including artificial intelligence, do not decide the outcome of a Report. Reports are decided by a human administrator under these Terms and applicable law, except that a claim of rights is decided by the courts or under Article 9.3.
9.8. Before permanent removal. Where a Capsule is to be permanently removed under Article 9.3, the Capsule Owner is notified 15 days in advance and can download a backup copy of the message and photograph during that time. Only the Capsule Owner can use this download. When the 15 days end, the Content is permanently deleted and can no longer be provided to anyone, including a court.
9.9. Refunds. No refund is made when a Capsule is removed following a Report, including after a year without a response, after a court decision or after the Capsule Owner accepts the claim. If a removal resulted from an error made by AenVault, the payment is refunded (Article 7.2).
9.10. Reporters. If you make a Report, you must provide accurate information and act in good faith. In a Report about a rights violation, you confirm that the information you provide is accurate and that you are acting in good faith, and you agree that your name (or your company's name) and the Report will be shared with the Capsule Owner. To prevent abuse, the number of Reports from the same source is limited, repeated Reports about the same Capsule for the same reason are limited, and a source that makes several Reports that are found to be unjustified may be temporarily prevented from making further Reports.
9.11. Notifications. Notifications to the Capsule Owner under this Article are sent to the primary email address of the account. If the account has been deleted, no notifications are sent (Article 11.2). Notices and messages about a removal describe it as a precaution following a possible breach of the Message Rules. They do not state that a breach has occurred.
9.12. Separate processes and mandatory rights. A Report, a payment dispute, a Legal Deletion Request and the deletion of your own Capsule are separate processes (Article 7.5). Nothing in this Article limits any right that applies to you under applicable mandatory law (Article 1.7).
Article 10 — Ownership and Licence
10.1. You keep your rights. You keep the copyright in your Content, including the message text and the photograph. These Terms do not transfer ownership of your Content to AenVault.
10.2. Licence to AenVault. By creating a Capsule and completing the purchase, you grant AenVault a licence to use your Content as needed to provide the Service. This covers storing and encrypting the Content, reviewing it (by automated review and, where these Terms provide for it, by an administrator), sealing the Capsule, displaying the Content publicly from the Opening Date and keeping it publicly available in the Archive as described in Article 2. AenVault may carry out these activities using the hosting, storage and review service providers it uses to operate the Service; the Privacy Policy explains how personal data is handled in this context. The licence is limited to these purposes and does not extend to any other use of your Content. Storage and review of Content that you have saved but not yet paid for are governed by Article 5 and the Privacy Policy.
10.3. Duration of the licence. The Archive has no fixed end date (Article 2.8), and the licence for the public display and Archive availability of your Content follows the same lifecycle. It continues after you delete your account if you choose to keep your Capsules (Article 11.2). It ends for Content that is deleted or removed under Article 4.5, or where applicable mandatory law requires it to end or limits its duration.
10.4. No licence for others. Making Content publicly viewable does not give anyone else a licence to copy, reproduce or reuse it. Rights in Content remain with their owners, and any use by others is governed by applicable law and by the permission of the rights holder. Once Content has been public, AenVault cannot prevent others from having copied it.
Article 11 — Deleting a Capsule or Your Account
11.1. Deleting a Capsule. You can delete any of your Capsules at any time from the "My Capsules" page, including after it has opened.
- Verification. You must be signed in, enter a one-time code sent to your primary email address and type "DELETE" to confirm.
- Waiting period. The deletion takes place 14 days after your request. During those 14 days, the Capsule stays as it is, the number of days left is shown, and you can cancel the deletion. If you cancel and later want to delete the Capsule, you make a new request and a new 14-day period starts.
- Deletion. When the 14 days end, the message and photograph are permanently deleted. The Capsule number is kept and is not reassigned. A deleted Capsule cannot be restored or recreated.
- Emails. You receive an email when your request is received and another when the Capsule has been deleted.
- No refund. Deleting a Capsule does not give rise to a refund (Article 7.2).
- Opened Capsules. If the Capsule has already opened, others may have copied its Content before it was deleted (Article 10.4).
- Pending processes. While a Report about the Capsule is being handled, or while the Capsule is subject to an official order or request (Article 17.4), the deletion waits and takes place once that process has ended.
- Only you. AenVault does not delete a Capsule on your behalf under this Article. A Legal Deletion Request is a separate process (Article 12).
11.2. Deleting your account. You can request the deletion of your account.
- Your Capsules. If you have sealed Capsules, you first choose whether to keep them or to delete them, and you are then asked to confirm the deletion of your account. You can go back and change your choice before confirming.
- Waiting period. Your account is deleted 14 days after your request, and you receive an email when the request is received. Until then, you can stop the deletion by signing in with your password and choosing to stop it. If you do, your account and your Capsules stay as they are. If you later want to delete your account, you make a new request and a new 14-day period starts.
- On deletion. When the 14 days end, your account is deleted. If you chose to keep your Capsules, they stay in their Collections and open on their Opening Dates. If you chose to delete them, they are permanently deleted on the same day, and their Capsule numbers are kept. Capsules for which payment has not been completed are deleted in either case. You receive an email confirming the deletion.
- After deletion. Once your account has been deleted, no notifications are sent to you about your Capsules, including the opening notification and the early closure notification (Article 13.2). If you need support for a kept Capsule, you will need to provide the email address of the account and proof of payment (Article 3.5).
- Pending processes. While a Report about any of your Capsules is being handled, or while any of your Capsules is subject to an official order or request (Article 17.4), the deletion of your account waits and takes place once that process has ended.
11.3. Record kept for each sealed Capsule. When a Capsule is sealed, a record consisting of the Capsule number and the email address of the account at that moment is created. It is kept even if the account is deleted or the Capsule is removed, and it is used only to verify ownership in Legal Deletion Requests (Article 12.4) and in support requests (Article 3.5). This record is not displayed in the interface. Details on its retention are set out in the Privacy Policy.
11.4. Data protection rights. Nothing in this Article limits your data protection rights under applicable law (Article 1.7).
Article 12 — Legal Deletion Requests
12.1. What a Legal Deletion Request is. A "Legal Deletion Request" is a request by a Capsule Owner for the permanent deletion of their Capsule that is assessed under the grounds and exceptions available under applicable data protection law and other mandatory legal requirements. It is separate from the deletion of your own Capsule or account under Article 11 and can be used even after your account has been deleted.
12.2. Who may make a request.
- Capsule Owners. A Capsule Owner makes a request through Channel A or Channel B below.
- Rights holders. A rights holder who is not the Capsule Owner may make a Report about Content that they state infringes their rights (Article 9). Where their request is supported by an order or request from a court, prosecutor, law enforcement body or similar public authority, or by a notarised notice of rights ownership or copyright infringement, an administrator may assess it directly under Article 17, without the steps in Articles 12.3 and 12.4. In every case, the decision is made by a human administrator after review.
12.3. Channel A: your account is active. Sign in to your account, open the Legal Deletion Request screen and enter the Capsule number. AenVault checks that the Capsule is recorded in your account and that the number you entered is correct.
12.4. Channel B: your account has been deleted. If your account has been deleted, use the form on the Legal Deletion Request page, which is available without signing in. Enter the email address that was recorded for the Capsule when it was sealed (Article 11.3) and the Capsule number. This channel is available for Capsules that have been sealed. If the details match that record, AenVault sends a one-time verification code to that email address.
- The code is generated and checked on AenVault's servers, can be used once and is valid for a short time only.
- Limits apply to the number of requests and to failed verification attempts. They exist for the security of the Platform, to prevent abuse and to protect against brute-force or automated attempts. For example, a code becomes invalid after a limited number of incorrect entries, and requests and verification attempts from the same source are limited over time.
- Entering the code correctly shows that you currently have access to that email address. Together with the Capsule number, this is the proof of ownership for the request.
- The code is used only to verify ownership for the request. It is not two-factor authentication, it is not used for signing in or account recovery, and it does not create an account or give access to any Content.
If ownership cannot be verified through Channel A or Channel B, for example because you can no longer sign in to an account that has not been deleted, you may still exercise your data protection rights through other means available under applicable law, including by contacting us using the details on the Legal Notice page. Such requests are handled under the Privacy Policy and applicable law, and they are separate from account access and from Channels A and B.
12.5. Review and decision. Completing ownership verification does not delete the Capsule automatically. The request then goes to a human administrator, who makes the final decision. The request is assessed on the grounds and exceptions described in Article 12.1. You receive an email when your request is received and another about the outcome.
12.6. If a request is approved. The Capsule and its Content are permanently removed. Information on backup copies, and on the records relating to the Capsule's existence, removal and payment that may be retained, is set out in the Privacy Policy.
12.7. No refund. The deletion of a Capsule following a Legal Deletion Request does not give rise to a refund unless applicable law requires otherwise (Article 7.2).
12.8. Relationship with other processes. A Legal Deletion Request is separate from a Report, from a payment dispute and from the deletion of your own Capsule or account (Article 7.5). The death or loss of legal capacity of a Capsule Owner does not create a right of early access (Article 4.3). Nothing in this Article limits your data protection rights under applicable law (Article 1.7).
Article 13 — Continuity of the Service and Early Closure Commitment
13.1. Reasonable efforts. AenVault will operate the Service, and maintain the Collection lifecycle including the Archive, using reasonable efforts. That the Archive has no fixed end date (Article 2.8) describes how the Collection lifecycle is designed. It is not a guarantee of uninterrupted operation or of a particular level of availability, and it is not an absolute or perpetual technical guarantee. Nothing in this Article limits your rights under applicable mandatory law, including in relation to the conformity of digital content or digital services (Article 1.7).
13.2. Early closure commitment. If AenVault decides to close the Service, sales stop on the day of that decision, and the Service closes 90 days later. From the day of the decision until the closing date, all Collections are open to everyone, so that the collective opening at the heart of the Service still takes place before it closes. On the day of the decision, 90 days before the closing date, we email every Capsule Owner at the primary email address of their account with a link to the download area on the Platform, where they can download a copy of their message and photograph until the closing date. Content that is hidden or has been removed under these Terms is not shown. No email is sent to a Capsule Owner whose account has been deleted (Article 11.2).
13.3. How Content is made available. Content in the Display Period and the Archive is made available through controlled, server-side access mechanisms. The Archive having no fixed end date (Article 2.8) does not mean that any Content is available at a permanent, fixed public file link.
13.4. Interruptions and the opening of a Collection. The Service may be temporarily interrupted, including by an interruption of a hosting, payment or email provider. When a Collection opens, the Content of many Capsules is made available at the same time. This may cause temporary slowdowns, queuing, caching delays or, in some cases, a temporary outage. The Collection opens at the fixed time stated in Article 2.4, but AenVault does not guarantee that every page or Capsule will be available at the exact moment of opening or without delay. Notification emails about the opening are sent over a period of time after the opening rather than all at once, and they may be delayed or not delivered. The opening and display of Content do not depend on them. Provisions on events beyond AenVault's reasonable control are set out in Article 14.6. Nothing in this Article limits your rights under applicable mandatory law (Article 1.7).
13.5. Transfer instead of closure. Where possible, and in compliance with applicable data protection law, AenVault will seek to transfer or hand over the Service and the stored Capsule data to a successor rather than close the Service. This is not a guarantee that a transfer or handover will be possible. If the Service is closed, Article 13.2 applies.
13.6. Change of operator. AenVault may transfer the operation of the Platform and the Service to another person or entity, including a company established to operate them. A transfer is made only on terms under which the new operator takes over AenVault's obligations to you under these Terms, including the early closure commitment in Article 13.2 and the obligations in respect of Capsules that have already been sealed, and it does not reduce the rights you have under these Terms or under applicable mandatory law. AenVault will give Account Holders reasonable advance notice of a transfer by email to the primary email address or by a prominent notice on the Platform, will publish the new operator's details on the Legal Notice page (Article 1.2), and will update the Privacy Policy to identify the operator responsible for personal data. Where applicable law requires your agreement to the transfer of your contract, or gives you a right to object to it or to end the contract because of it, AenVault will comply with that requirement or right before the transfer takes effect for your contract. Personal data is transferred only as data protection law and the Privacy Policy allow. Article 15.4 applies to the governing law and courts.
13.7. Responsibility. AenVault's responsibility in connection with this Article is addressed in Article 14. Nothing in that Article limits liability that cannot be limited or excluded under applicable mandatory law.
Article 14 — Limitation of Liability
14.1. Mandatory law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law. Depending on the applicable law, this may include liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for intent or gross negligence, liability for the conformity of digital content or digital services and the remedies for non-conformity, and liability under data protection law. Nothing in these Terms limits your rights as a consumer or your data protection rights that cannot be waived by contract (Article 1.7). Where such a right applies, this Article applies only to the extent applicable mandatory law permits.
14.2. Accuracy of Content. AenVault is not responsible for the accuracy of the Content that Account Holders create. Responsibility for Content rests with the Account Holder as set out in Article 8.1. This does not affect AenVault's own obligations under applicable law, including its obligations as a controller of the personal data it processes.
14.3. Service provided as is. Subject to Article 14.1, the Service is provided "as is". This does not affect any right you have under applicable mandatory law relating to the conformity of digital content or digital services and remedies for non-conformity (Article 4.4).
14.4. Automated review. Content is reviewed by automated systems, including artificial intelligence (Articles 5.3 and 8.3). Such review can, in exceptional cases, produce an incorrect result. It is not guaranteed to be accurate. If automated review does not find the Content of a Capsule acceptable, Articles 5.3 and 7.2 apply.
14.5. Limit for technical or operational fault. Subject to Article 14.1, AenVault's liability for a technical or operational fault in the Service is limited to the price paid for the Package of the Capsule concerned. This limit does not affect any refund provided for in Article 7 or any statutory right or remedy that applies to you (Articles 7.3 and 14.1).
14.6. Events beyond reasonable control. Temporary interruptions or delays in the Service caused by events beyond AenVault's reasonable control, that is, events that AenVault could not reasonably have prevented or avoided, are not a breach of these Terms. Such events may include natural disasters, war, large-scale cyberattacks that could not have been prevented by the security measures described in Article 4.6, a major interruption of a hosting, payment or email provider that AenVault could not reasonably have avoided, and changes in law. An ordinary technical or operational fault within AenVault's control is not such an event and is dealt with under Article 14.5. This applies only to interruptions and delays. It does not relieve AenVault of the obligation to apply the security measures described in Article 4.6, and it does not limit any liability that arises under applicable law, including data protection law, in connection with a failure to apply those measures. Article 14.1 also applies.
14.7. Continuity of the Service. Subject to Article 14.1, claims arising in connection with Article 13 are limited as provided in Article 14.5.
Article 15 — Governing Law and Jurisdiction
15.1. Mandatory rights. Nothing in this Article deprives you of the protection that the mandatory provisions of the law of the country where you habitually reside give you, to the extent that law applies to your purchase, or of any consumer or data protection right that cannot be waived by contract (Article 1.7). Nor does it limit any right you have under applicable law to bring proceedings before the courts of your own country, or to contact a competent consumer protection or data protection authority.
15.2. Governing law. Subject to Article 15.1, these Terms, and your contract with AenVault for the Service that you purchase through Lemon Squeezy, are governed by the law of the country in which the operator named on the Legal Notice page at the time you complete your purchase (or, if you use the Platform without making a purchase, at the time of use) has its place of residence or establishment.
15.3. Courts. Subject to Article 15.1, the courts of that country have jurisdiction over disputes arising from these Terms or from your contract with AenVault. This does not limit any right you have under applicable mandatory law to bring proceedings in another court.
15.4. Change of operator. If the operator named on the Legal Notice page changes (Article 13.6), the law and courts that applied to your purchase under Articles 15.2 and 15.3 at the time you completed it continue to apply to that purchase and to your Capsule throughout its lifecycle. The law and courts determined by the operator named on the Legal Notice page at the time of purchase apply to purchases completed after that change. A change of operator does not reduce the rights you have under these Terms or under applicable mandatory law.
15.5. Lemon Squeezy. Your purchase from Lemon Squeezy, including the payment transaction, is subject to Lemon Squeezy's Buyer Terms, as set out in Article 1.4. The law and courts applicable to those terms are determined by them and do not change the provisions of this Article for your contract with AenVault.
Article 16 — No Early Access by Heirs or Third Parties
16.1. No early access. The death or loss of legal capacity of a Capsule Owner does not give heirs, guardians, representatives or any other third party a right to open a Capsule before the Opening Date of its Collection (Article 4.3). No request, payment or document submitted under these Terms creates such a right.
16.2. Official documents. If an heir, guardian or other person submits official documents, such as a certificate of inheritance or a guardianship decision, the documents may be reviewed by an administrator as a separate matter under Article 17. Submitting documents does not by itself create a right of early access, and any decision is made by a human administrator under these Terms and applicable law.
16.3. Mandatory law and public authorities. This Article does not prevent the application of mandatory rights recognised by applicable law that cannot be waived by contract, or of decisions of public authorities (Article 4.3).
16.4. Requests to delete. Whether an heir, guardian or other representative may make a Legal Deletion Request on behalf of a deceased or incapacitated Capsule Owner depends on applicable law. Article 12 applies to such a request only to the extent applicable law permits it.
Article 17 — Official Authority Orders and Mandatory Removal
17.1. Official orders and mandatory requirements. A Capsule, including one in the Display Period or in the Archive, is removed where a lawful order from a competent court, prosecutor, law enforcement body or similar public authority, or another mandatory legal requirement, applies (Article 4.5). A notarised notice of rights ownership or copyright infringement is not an order of a court or public authority, and it does not by itself require removal. It is assessed by a human administrator under Article 17.2 and may lead to removal only if the administrator decides after review that removal is justified (Article 4.5).
17.2. Direct assessment. Where AenVault receives such an order, request or notice (Article 12.2), an administrator may assess it directly, without the ownership verification steps in Articles 12.3 and 12.4, which apply to requests made by Capsule Owners. The decision is made by a human administrator after review.
17.3. Effect. If the removal is carried out, the Capsule and its Content are permanently removed. Information on backup copies, and on the records relating to the Capsule's existence, removal and payment that may be retained, is set out in the Privacy Policy.
17.4. Pending official proceedings. While a request or proceedings of a court, prosecutor or other public authority concerning a Capsule are pending, the Capsule is not permanently deleted, and the deletion of the Capsule by its Capsule Owner and the deletion of the Capsule Owner's account wait until the request or proceedings have ended (Article 11).
17.5. Refunds. A removal under this Article does not give rise to a refund unless applicable law requires otherwise (Articles 7.2 and 12.7).
17.6. Separate processes; mandatory rights. A removal under this Article is separate from a Report, a payment dispute, a Legal Deletion Request made by a Capsule Owner and the deletion of a Capsule by its Capsule Owner (Article 7.5). Nothing in this Article limits any right you have under applicable mandatory law, including any right to challenge an order or request before the competent authority (Article 1.7).
Article 18 — Account Suspension and Termination
18.1. Grounds and measures. In the case of suspected fraud, abuse of the Platform, automated or bot-generated requests, or a legal requirement, AenVault may, to the extent reasonably necessary and proportionate, temporarily restrict access to an account or terminate the account. A breach of the Message Rules is dealt with under Articles 8 and 9 and does not, by itself, lead to a measure under this Article.
18.2. Effect on Capsules. A measure under this Article does not affect the status of a Capsule for which payment has been completed and which has been sealed. Such a Capsule continues through its lifecycle and can be removed only in the cases set out in Article 4.5. Article 4.2 continues to apply, so the measure does not give anyone access to sealed Content.
18.3. Mandatory rights and contact. Where applicable mandatory law requires notice, reasons or an opportunity to respond in connection with a measure under this Article, AenVault will provide them. If you believe a measure has been applied in error, you can contact us using the details on the Legal Notice page. This Article does not limit any right you have under applicable mandatory law (Article 1.7).
Article 19 — Changes to the Terms
19.1. Right to update. AenVault may update these Terms for valid reasons, including:
- a change in law, regulation or the requirements of a competent authority;
- a change of operator (Article 13.6), of the operator's contact details, or in the terms or services of Lemon Squeezy (Article 6.1);
- a technical, security or operational change to the Platform or the Service;
- the introduction of new Packages, products or features; or
- the correction of errors or the clarification of wording.
19.2. Notice. The current version of the Terms and the date on which it takes effect are published on the Platform. For material changes, AenVault gives reasonable advance notice by email to the primary email address of Account Holders or by a prominent notice on the Platform.
19.3. Effect. An updated version applies from the date on which it takes effect, to use of the Platform and to purchases made after that date. The version that applied to a purchase you have already completed is recorded and remains available (Article 1.5).
19.4. Purchases already completed. An update does not change the fixed Opening Date of the Collection to which your Capsule is assigned (Article 2.6), the price you paid or the scope of the Package you purchased, and it does not reduce rights you already have in respect of a Capsule you have purchased, except where the change is required by applicable law or by a competent authority.
19.5. Consent and mandatory rights. Where applicable mandatory law requires your consent to a change, or a specific form of notice, AenVault will obtain or give it as the law requires, and the change applies to you only once that requirement has been met. Nothing in this Article limits any right you have under applicable mandatory law (Article 1.7).
Article 20 — General Provisions
20.1. Severability. If a provision of these Terms is held to be invalid or unenforceable in a jurisdiction, the remaining provisions stay in force in that jurisdiction, and the affected provision applies to the extent permitted by applicable law. This does not reduce any right you have under applicable mandatory law.
20.2. No waiver. A delay or failure by AenVault in enforcing a provision of these Terms is not a waiver of that provision or of any right, unless AenVault expressly says so in writing.
20.3. Whole agreement. These Terms, together with the documents referred to in Article 1.6 and the information and confirmations presented at checkout, set out the agreement between you and AenVault regarding the Platform and the Service. This does not affect any information that applicable law requires to be treated as part of the contract.
20.4. Notices and contact. Where these Terms provide for notice by email, AenVault sends it to the primary email address of your account. You are responsible for keeping your email address up to date (Article 3.2). You can contact us using the details on the Legal Notice page.
20.5. No third-party rights. Except where applicable mandatory law provides otherwise, no one other than you and AenVault has rights under these Terms. This includes the recipient of a message (Article 3.4) and heirs or other third parties (Article 16).
20.6. AenVault's rights. The Platform, including its software, design, name and logo, belongs to AenVault or its licensors. These Terms do not transfer any of these rights to you. You keep your rights in your Content (Article 10.1).
